TERMS AND CONDITIONS

1. INTRODUCTION & ACCEPTANCE

Welcome to PokiPaw (“App”, “Platform”, “Service”), operated by Trinx Solutions S.R.L., a company incorporated under Romanian law, with registered office at Str. Loichita Vasile 1 Sc. D Et. 5 Ap. 41, Timisoara, Timis County, Romania (“we”, “us”, “our”).

By downloading, installing, accessing, or using the App, you (“User”, “you”) confirm that you have read, understood, and agree to be bound by these Terms and Conditions (“Terms”), our Privacy Policy, and any additional policies referenced herein.

If you do not agree to these Terms, do not use the App.

These Terms constitute a legally binding agreement between you and Trinx Solutions S.R.L. governing your access to and use of the App on iOS, Android, and the web.

2. DEFINITIONS

“App” / “Platform” — The PokiPaw mobile and web application and all associated services.
“User” — Any individual who creates an account and uses the App.
“Content” — Text, images, documents (e.g., vaccine certificates), pet profile data, and other materials uploaded by Users.
“Pet Data” — Information related to a pet, including health records, photos, and medical history.
“Personal Data” — Any information relating to an identified or identifiable natural person, as defined under GDPR.
“Health Data” — Pet health and medical records which, when linked to a person, may constitute special category data under GDPR Article 9.
“Subscription” — A recurring paid plan (Premium or Family Seats) sold via Apple In-App Purchase or Google Play Billing.
“Family Sharing” — A feature allowing a primary account holder to share pet data with household members through a join code.
“GDPR” — Regulation (EU) 2016/679 of the European Parliament and of the Council.

3. ELIGIBILITY & ACCOUNT REGISTRATION

3.1 Age Requirements

The App is available to users aged 16 and over. Users between 16 and 18 may use the App independently in jurisdictions where the minimum age of digital consent is 16 (including Romania under GDPR Article 8).

Users under 16 may only use the App with verified consent of a parent or legal guardian, who accepts these Terms on the minor’s behalf and assumes full responsibility for their use.

3.2 Account Registration

You may create an account with email + password, Google Sign-In, or Sign in with Apple. You agree to:

Provide accurate, current, complete information
Keep your credentials confidential
Notify us immediately of any unauthorized access at support@pokipaw.com
Not share your account (except through Family Sharing)
Not create multiple accounts to evade restrictions or bans

You are solely responsible for activity on your account.

3.3 Account Accuracy

You represent that all information you provide is truthful and up to date.

4. DESCRIPTION OF SERVICES

PokiPaw is a pet management app. Features include:

Daily Journal	Track walks, food, water, sleep, weight, mood, grooming
Expense Tracking	Log pet-related costs and view monthly trends
Photo Gallery & Documents	Upload pet photos and supporting documents (e.g., vaccine certificates)
Family Sharing	Share pet data with household members via a join code
Community Map	Discover nearby vets, pet shops, and parks via Google Maps
Emergency Tools	Quick access to vet finder, poison control numbers, and emergency info
Lost & Found	Report a lost pet or help find an owner of a found pet
Adoption Posts	List pets available for adoption
Push Notifications	Reminders for vaccinations, medications, and family activity
PDF Export	Generate a pet health report PDF for vet visits

We reserve the right to add, modify, or discontinue features at any time with reasonable notice.

5. SUBSCRIPTIONS & PAYMENTS

5.1 Free Tier

PokiPaw offers a free tier with the core feature set. No payment is required to create an account or use the App at the free tier.

5.2 Premium and Family Seats

Optional paid tiers unlock additional capacity and features:

Premium — paid monthly or annually
Family Seats — additional invited members of your Family Sharing group

Pricing is shown in the App and may vary by region and currency.

5.3 Payment Processing

All subscription payments are handled by Apple In-App Purchase (on iOS) or Google Play Billing (on Android). Trinx Solutions S.R.L. does not receive or store your card details — they are handled entirely by Apple or Google under their respective terms.

By subscribing you also accept the applicable Apple Media Services Terms or Google Play Terms of Service.

5.4 Billing & Renewal

Subscriptions automatically renew at the end of each billing period through Apple or Google unless cancelled in your App Store / Google Play subscription settings before the renewal date.
Apple or Google may send a renewal reminder where required by applicable law.
Prices may change with 30 days’ prior notice. Continued use after the notice period constitutes acceptance of the new pricing.

5.5 Right of Withdrawal (EU Users)

If you are an EU consumer, you have a 14-day right of withdrawal from the date of your initial subscription purchase. By starting to use the premium features within this period, you expressly request immediate performance and acknowledge that you lose your right of withdrawal upon full performance.

5.6 Refunds

Refunds are governed by the policies of Apple App Store and Google Play, where the payment was made. Where required by EU consumer law, additional refund rights apply. To request a refund, follow Apple’s or Google’s process or contact support@pokipaw.com and we will assist where possible.

5.7 Taxes

Prices shown via Apple/Google may include or exclude applicable VAT depending on your region. Apple/Google collect and remit applicable taxes.

A primary account holder (“Family Admin”) may invite household members (“Family Members”) by sharing a join code.
Each Family Member must create their own account and agree to these Terms individually.
The Family Admin is responsible for ensuring Family Members comply with these Terms.
Family Members under 16 require parental consent (Section 3.1).
Pet data shared inside a Family Sharing group is accessible to all members of the group. The Family Admin manages who is in the group.
Removing a Family Member revokes their access to shared pet profiles but does not delete their own account data.

7. LOST & FOUND

7.1 Feature

Lost & Found lets Users post a lost or found pet report with photos, description, approximate location, and contact preferences.

7.2 Location

You control the precision of the location shared. We strongly recommend posting neighbourhood-level location rather than your exact home address.

7.3 User Obligations

By posting a Lost or Found report you confirm that:

The information provided is accurate and truthful to the best of your knowledge
For lost pets: you are the owner or authorized representative of the pet
For found pets: you are acting in good faith to reunite the animal with its owner

7.4 Prohibited Use

You must not use Lost & Found to:

Claim ownership of an animal that is not yours
Resell or rehome a found animal for profit
Post misleading or fabricated reports
Harvest contact information from other users

7.5 No Guarantee

Trinx Solutions S.R.L. does not guarantee the recovery of any lost pet, the accuracy of any posted report, or the identity or intentions of responding users. We strongly recommend verifying identity before handing over a pet.

7.6 Report Lifecycle

Reports are automatically archived 30 days after being marked resolved. You may mark a report as resolved at any time. We may remove reports that violate these Terms.

8. ADOPTION POSTS

8.1 Feature

You may post pets available for adoption. Other Users may browse posts and contact you through the App.

8.2 Our Role

We are a technology platform, not an animal shelter, rescue, or adoption agency. We do not verify the health, history, or legal status of listed animals and we are not a party to any adoption agreement.

8.3 Lister Obligations

By posting, you confirm that:

You have lawful authority to place the animal for adoption
The animal is in good health to your knowledge, or any known issues are disclosed
All information in the post (species, breed, age, vaccination status, temperament) is accurate
You will not charge an adoption fee exceeding reasonable care costs unless permitted by local law
You comply with all applicable EU and national animal welfare law

8.4 Adopter Acknowledgement

Anyone considering an adoption acknowledges that:

They are solely responsible for assessing suitability of the animal
They will comply with all applicable laws regarding animal ownership
Trinx Solutions S.R.L. is not liable for issues arising after adoption (behaviour, undisclosed health, disputes with the Lister)

8.5 Prohibited Listings

The following are strictly prohibited and will result in immediate removal and potential account termination:

Animals obtained through theft, illegal breeding, or animal cruelty
Protected or exotic species offered for sale
Listings facilitating commercial puppy/kitten mills
Any listing violating EU or national animal welfare regulations

9. COMMUNITY MAP

9.1 Map Data

The Community map is powered by Google Maps Platform. Your use of map features is also subject to Google’s Terms of Service and Privacy Policy.

9.2 Place Information

Place listings (vets, parks, shops) come from Google Places. We do not run a paid placement or “promoted listings” program — Trinx Solutions S.R.L. has no commercial agreement that influences the ranking of any place shown in the map.

9.3 Accuracy Disclaimer

Opening hours, addresses, and place availability may be outdated. Always verify directly with the place before visiting.

9.4 Location Privacy

Location handling is described in our Privacy Policy at https://www.pokipaw.com/privacy-policy. You may disable location access in your device settings, which will limit map features.

10. USER CONTENT

10.1 What You Post

You may upload pet photos, documents, journal entries, expense data, lost & found and adoption posts. You retain ownership of everything you upload.

10.2 License to Us

By uploading Content, you grant Trinx Solutions S.R.L. a worldwide, non-exclusive, royalty-free, sublicensable license to host, store, display, reproduce, and reformat your Content for the sole purpose of operating the App. This license ends when you delete the Content or your account.

10.3 Third-Party Appearances

If your Content shows other people, ensure you have the right or consent to post it. Do not post images of others without their permission.

10.4 Content Standards

You agree not to post Content that:

Is unlawful, harmful, threatening, abusive, harassing, defamatory, or invasive of privacy
Depicts or promotes animal abuse, cruelty, neglect, or illegal animal practices
Infringes intellectual property of third parties
Contains spam, unsolicited promotions, or chain messages
Includes malware or harmful code
Spreads misinformation about animal health or veterinary practices
Exploits, sexualizes, or harms minors in any way

10.5 Reporting & Moderation

You can report Content via the in-app “Report” flow. Reports are reviewed within 24 hours. While a report is pending, Content flagged by three or more distinct users is auto-hidden from non-author accounts so harmful Content cannot circulate during review.

Action may include removal, a warning, account suspension, or escalation to authorities where required by law. We are not obligated to review all Content proactively but reserve the right to do so. For status, contact support@pokipaw.com.

10.6 No Endorsement

User Content does not represent the views of Trinx Solutions S.R.L. We are not responsible for the accuracy of User-posted health advice or recommendations.

11.1 Data Controller

Trinx Solutions S.R.L. is the Data Controller for all Personal Data processed through the App. For data protection queries: privacy@pokipaw.com.

11.2 Pet Health Data (Special Category)

Pet health records may constitute special category data under GDPR Article 9 because they are linked to you as the owner. We process them only with your explicit consent, which you may withdraw at any time.

Access, rectification, erasure, restriction, portability, objection, withdrawal of consent, complaint to a supervisory authority. See our Privacy Policy at https://www.pokipaw.com/privacy-policy for full details. Submit data deletion requests at https://www.pokipaw.com/delete-data.

12. INTELLECTUAL PROPERTY

12.1 Our Rights

Trinx Solutions S.R.L. owns all rights, title, and interest in and to the App, including source code, design, UI/UX, branding, trademarks, logos, original content, and editorial features.

You may not copy, reproduce, modify, distribute, reverse engineer, decompile, or create derivative works from any part of the App without our express prior written consent.

12.2 Limited License to You

We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the App for personal, non-commercial purposes in accordance with these Terms.

12.3 Your Content License

As stated in Section 10.2, you retain ownership of your Content but grant us a license to use it to operate the App.

12.4 Feedback

Suggestions or feedback you submit may be used by us without restriction or compensation.

12.5 Third-Party Components

The App incorporates open-source libraries and third-party SDKs (e.g., Google Maps, Firebase, PostHog, Sentry, Supabase). We comply with all applicable open-source and third-party licensing requirements.

13. PROHIBITED CONDUCT

You agree not to:

Technical:

Reverse engineer, decompile, or attempt to extract source code
Probe, scan, or test the App for vulnerabilities without written authorization
Introduce malware or any malicious code
Attempt to gain unauthorized access to any system, account, or data
Interfere with or disrupt the App’s infrastructure
Use bots, crawlers, or automated scripts to interact with the App

Account:

Create accounts using false identities
Circumvent account bans by creating new accounts
Share account credentials with unauthorized third parties
Impersonate Trinx Solutions S.R.L. employees, veterinarians, or other users

Commercial:

Use the App for unsolicited commercial solicitation
Harvest User data for marketing without consent
Resell or sublicense access to the App

Legal & ethical:

Use the App in violation of applicable law
Engage in discrimination, harassment, or hate speech
Facilitate or promote animal abuse, illegal breeding, or trafficking
Manipulate health data or medical records fraudulently

Violation may result in immediate suspension, termination, and where applicable, reporting to relevant authorities.

14. THIRD-PARTY SERVICES

The App integrates the following third-party services to operate:

We do not use any advertising or marketing networks. The App does not run ads.

Your use of these third-party services is also subject to their own terms and privacy policies. Trinx Solutions S.R.L. is not responsible for outages or changes in those services that may affect dependent features. Integration of a third-party service does not constitute an endorsement.

15. DISCLAIMER OF WARRANTIES

To the fullest extent permitted by applicable law, Trinx Solutions S.R.L. expressly disclaims all warranties, whether express, implied, or statutory, including:

Merchantability — we do not warrant the App is of merchantable quality
Fitness for purpose — the App is not warranted to meet your specific needs
Accuracy — we do not warrant the accuracy of health analytics, recommendations, map data, or user-submitted content
Continuity — we do not warrant uninterrupted, error-free, or secure access to the App

Health features are informational only and do not constitute veterinary advice. Always consult a licensed veterinarian for medical decisions for your pet.

Nothing in this section limits liability where such limitation is prohibited under EU or Romanian consumer protection law.

16. LIMITATION OF LIABILITY

16.1 Cap

To the maximum extent permitted by applicable law, Trinx Solutions S.R.L.’s total aggregate liability arising from or related to these Terms or your use of the App shall not exceed:

(a) the fees you paid to Trinx Solutions S.R.L. in the 12 months preceding the claim; or
(b) €100, whichever is greater.

16.2 Excluded Damages

We shall not be liable for any:

Indirect, incidental, consequential, or special damages
Loss of profits, revenue, data, or business opportunities
Injury, illness, or death of a pet arising from reliance on App-generated information
Damages arising from third-party service failures
Damages resulting from unauthorized account access due to your failure to maintain credential security

16.3 Exceptions

Nothing excludes or limits liability for:

Death or personal injury caused by our negligence
Fraud or fraudulent misrepresentation
Liability that cannot be excluded under Romanian or EU consumer protection law
Breach of GDPR obligations

17. INDEMNIFICATION

You agree to defend, indemnify, and hold harmless Trinx Solutions S.R.L., its affiliates, directors, officers, employees, and agents from any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising from:

Your breach of these Terms
Content you upload
Your violation of applicable law or regulation
Your infringement of any third-party intellectual property or privacy rights
Unauthorized use of another User’s account facilitated by you

We reserve the right to assume exclusive control of the defense of any matter subject to your indemnification, at your expense.

18. ACCOUNT SUSPENSION & TERMINATION

18.1 Termination by You

Delete your account at any time via Settings → Account → Delete Account or at https://www.pokipaw.com/delete-data. Upon deletion:

Your access is immediately revoked
Personal data is handled per the Privacy Policy retention schedule
Family Members lose shared access to your pets
Subscriptions must be cancelled separately in your Apple App Store or Google Play subscription settings — Trinx Solutions S.R.L. cannot cancel them on your behalf

18.2 Termination by Us

We may suspend or permanently terminate your account:

With notice: for extended inactivity, subscription non-payment, or minor Terms violations
Without notice: for serious violations including fraud, abuse, illegal conduct, or threats to platform security

18.3 Appeals

You may appeal a suspension or termination within 30 days by contacting support@pokipaw.com with a written explanation. We will review appeals within 15 business days.

18.4 Survival

Sections 10.2 (Content License), 12 (Intellectual Property), 15 (Disclaimers), 16 (Limitation of Liability), 17 (Indemnification), 20 (Governing Law), and any accrued obligations survive termination.

19. CHANGES TO THE APP & THESE TERMS

19.1 App Changes

We continuously develop the App and may add, modify, or remove features at any time. We will make reasonable efforts to notify Users of significant changes via in-app notice.

19.2 Changes to These Terms

For material changes we will:

Provide at least 30 days’ advance notice via in-app notification and/or email
Display a summary of key changes
Require re-acknowledgement where significant

Continued use of the App after the effective date constitutes acceptance. If you disagree, stop using the App and delete your account before the changes take effect.

20. GOVERNING LAW & DISPUTE RESOLUTION

20.1 Governing Law

These Terms are governed by the laws of Romania, including applicable European Union law (in particular GDPR and EU consumer protection directives), without regard to conflict of law principles.

20.2 Mandatory Consumer Rights

Nothing in these Terms shall restrict or override the mandatory consumer protection rights granted to EU consumers under Directive 2011/83/EU (Consumer Rights Directive) or applicable Romanian consumer law.

20.3 Informal Resolution

Before initiating formal legal proceedings, both parties agree to attempt to resolve any dispute informally by contacting legal@pokipaw.com. We will acknowledge within 5 business days and try to resolve within 30 days.

20.4 Jurisdiction

If informal resolution fails, disputes shall be subject to the exclusive jurisdiction of the courts of Timișoara, Timiș County, Romania, except where:

Mandatory EU consumer law requires access to courts in your country of residence
Applicable law provides otherwise

20.5 EU Online Dispute Resolution

20.6 Class Action Waiver

To the extent permitted by applicable law, any dispute will be brought on an individual basis only and not as part of a class, collective, or representative action. This waiver does not apply where prohibited by EU or Romanian law.

21. MISCELLANEOUS

21.1 Entire Agreement

These Terms, together with the Privacy Policy (https://www.pokipaw.com/privacy-policy) and Cookie Policy (https://www.pokipaw.com/cookies), constitute the entire agreement between you and Trinx Solutions S.R.L. regarding the App and supersede all prior agreements.

21.2 Severability

If any provision is held invalid, illegal, or unenforceable, it shall be modified to the minimum extent necessary to make it enforceable, and the remaining provisions shall remain in full force.

21.3 No Waiver

Our failure to enforce any right or provision shall not constitute a waiver of that right. Any waiver must be in writing and signed by an authorized representative.

21.4 Assignment

You may not assign your rights or obligations without our prior written consent. We may assign our rights to a successor entity in a merger, acquisition, or sale of assets, with notice to you.

21.5 Force Majeure

We shall not be liable for any delay or failure in performance resulting from causes beyond our reasonable control, including acts of God, pandemics, war, terrorism, government orders, internet or infrastructure outages, or third-party service failures.

21.6 Notices

Legal notices to Trinx Solutions S.R.L. must be sent to legal@pokipaw.com or by post to our registered address. Notices to you will be sent to the email associated with your account or via in-app notification.

21.7 Language

These Terms are offered in English as the primary language. Translated versions are for convenience only; in the event of conflict, the English version prevails.

21.8 Relationship of Parties

Nothing in these Terms creates a partnership, joint venture, employment, agency, or franchise relationship between you and Trinx Solutions S.R.L.
